Criminal Rehabilitation and Temporary Resident Permits (TRPs)

Individuals with certain criminal records may be inadmissible to Canada. It is important to determine first whether the criminal record in question makes a person inadmissible. If you are inadmissible there are legal options to overcome this inadmissibility: Criminal Rehabilitation and Temporary Resident Permits (TRPs).

  1. Criminal Rehabilitation: This is a permanent solution for individuals who have completed their sentences at least five years prior and have demonstrated that they are unlikely to re-offend. Applicants must provide documentation proving they have been rehabilitated, and if approved, they are no longer considered inadmissible to Canada based on their past criminal conviction.

    In some cases, where the criminal conviction does not rise to the level of “serious criminality,” a potential visitor or immigrant may be deemed rehabilitated after ten years have passed since the completion of their sentence.

  2. Temporary Resident Permit (TRP): If an visitor or immigrant is not eligible for Rehabilitation or of the Rehabilitation process takes too long, they may be able to apply for a Temporary Resident Permit (TRP). TRPs are granted at the discretion of Canadian immigration authorities and are only issued when there is a compelling reason for the visit that outweighs the risk to Canadian society. TRPs are temporary and must be applied for each time an individual seeks entry to Canada.
